Terms and Conditions

Outdoor Croatia is registered as Pustolovni Centar d.o.o. with Dubrovnik Court of Commerce due to specific laws and regulations that  prohibit companies from registering names in foreign language.

 

1. REGISTRATIONS AND PAYMENTS

Pustolovni Centar d.o.o. acting as the Organiser shall guarantee the execution of the travel programme. At registration, the Traveller shall pay 30% of the package tour value, and the remaining 70% of the amount shall be paid no later than 21 days prior to commencement of the trip itself, save in cases where individual trips are modified by special terms of payment or in cases where the deadline before commencement of the trip is less than 21 days.

By paying the first installment and/or by paying part of the package tour containing traveller’s basic data and information on the programme the Traveller is paying for, the Traveller shall accept in its entirety, and confirm that all items of these Terms and Conditions have been understood, therefore everything that is written herein shall become legally binding on both the Traveller and the Organiser.

 

2. PACKAGE TOUR PRICE AND CONTENT

The Organiser shall reserve the right to make modifications to prices made public in case of drastic changes in hotel prices, transport prices and other services. The Traveller’s (Buyer’s) consent is not needed in cases where the package tour price has been increased up to 5%. At price increase surpassing 5%, the Traveller (Buyer) is entitled to cancel the agreement without having to cover any losses.

The prices of programmes are listed in various currencies, but Hrvatska kuna (HRK – Croatian national currency) is the sole official valuation in the Republic of Croatia. The prices in other currencies are liable to exchange rate fluctuations. The price is based on accommodation in two-bedded rooms, and in case the Traveller prefers to be alone in the room, the Traveller is obliged to make an extra payment for a single room (single supplement).

The package tour price usually includes (unless the programme reads otherwise) accommodation and breakfast, other meals as stated in the trip programme, transfers, adventurous activities contained in the trip programme (kayak, bicycles, hiking etc.) with all appertaining equipment and a guide. The prices of one-day and half-day excursions usually include (unless the programme reads otherwise) transfers, adventurous activities contained in the trip programme (kayak, bicycles, hiking etc.) with all appertaining equipment and a guide.

The prices do not include (unless the programme reads otherwise) optional excursions, personal spending and drinks with any meals except breakfast.

 

3. ROOM / SUITE ACCOMMODATION  

Most package tours include accommodation in rooms owned by private renters. These are usually rooms with 3* (unless the programme reads otherwise) which provide basic comfort, that is to say a clean, tidy room that is without any luxurious accessories.

The Organiser shall be entitled to make changes to the agreed upon accommodation solely by accommodation of the same or higher category, and exclusively at the Organiser’s own expense. The Organiser shall be entitled to make changes to excursion schedule on a daily basis.

 

4. CANCELLATION OF TRAVEL 

Multi-day tours:

If the Traveller should cancel or abort the travel, the Traveller is obliged to do so by sending an email. The written cancellation date shall be the basis for the compensation of cancellation costs which shall be collected by the trip organiser as per conditions set forth below (individual cancellations – up to 6 persons):

- Up to 30 days before the start of the trip the Agency shall withhold 10% of the package tour price,
  and/or at least HRK 100

- 29 to 22 days before the start of the trip the Agency shall withhold 25% of the package tour price

- 21 to 15 days before the start of the trip the Agency shall withhold 40% of the package tour price

- 14 to 8 days before the start of the trip the Agency shall withhold 80% of the package tour price

- 7 to 0 days before the start of the trip the Agency shall withhold 100% of the package tour price

Failing to make appearance and travel without prior cancellation shall entitle the Agency to withhold 100% of the payment made regardless of the reason or reasons for the cancellation.

Group cancellation (for more than 6 persons):

The Agency shall withhold: up to 90 and more days before the start of the trip –  20%; from 89 to 30 days –  40%; from 29 to 15 days – 70%; from 14 to 0 days – 100%. Failing to make appearance and travel without prior cancellation shall entitle the Agency to withhold 100% of the payment made regardless of the reason or reasons for the cancellation.

If terms and conditions of a separate agreement that is entered into read differently, or the trip programme reads differently, then the terms and conditions as well as cancellation rules from that separate agreement or trip programme shall apply and be considered valid.

Half and Full-Day Tours:

If the Traveller should cancel or abort the travel, the Traveller is obliged to do so by sending an email. The written cancellation date shall be the basis for the compensation of cancellation costs which shall be collected by the trip organiser as per conditions set forth below (both individual and group cancellations):

- 11  and more days before the start of the trip the Agency shall withhold 70% of the tour price

- 10 to 0 days before the start of the trip the Agency shall withhold 100% of the  tour price

Failing to make appearance and travel without prior cancellation shall entitle the Agency to withhold 100% of the payment made regardless of the reason or reasons for the cancellation.

 

5. CASUALTY AND DISEASE INSURANCE, RISK OF DAMAGE AND BAGGAGE LOSS INSURANCE, VOLUNTARY HEALTH INSURANCE FOR PERSONS FOR TIME SPENT ON TRAVEL AND ABROAD

The travel prices do not include risk of damage and baggage loss insurance, cancellation and curtailment insurance, nor do they include voluntary health insurance. By making the payment for an excursion or a package tour, which are integral to the Terms and Conditions herein, as well as the trip programme, it is deemed that the Traveller(s) has/have thus been advised to take additional health, cancellation and curtailment insurances which can be purchased directly at an insurance company of one’s own choice. Pustolovni Centar d.o.o. has basic insurance coverage for casualty and disease insurance.

 

6. ORGANISER’S RIGHT TO CANCEL OR CHANGE PROGRAMME  

The Organiser shall be entitled to fully or partially cancel the package tour should before or during the execution of the trip any extraordinary circumstances which could not be eliminated or avoided occur – such as bad weather on land or at sea.

Pustolovni Centar d.o.o. shall reserve the right to fully or partially alter the trip (package tour) should extraordinary circumstances, which could not be foreseen or avoided, occur immediately before the start of the trip.

In these cases, the Organiser shall refund the Traveller in full.

 

7. TRAVEL DOCUMENTS

The Travellers are obliged to own valid travel documents. Invalid travel documents which may cause cancellation shall have no ill effects on Pustolovni Centar d.o.o., and in case any such negligence or omission made by the Traveller should bring upon additional damage to Pustolovni Centar d.o.o., the Traveller shall be obliged to reimburse Pustolovni Centar d.o.o. in the amount of the incurred damage.

Should during the travel period travel documents be lost or stolen, the cost of issuing and acquiring new documents shall be borne by the Traveller. The Organiser’s assistant shall provide assistance to the Traveller in the above mentioned case, at the same time taking into account that the programme is executed normally and according to plan.

The Traveller is obliged to make inquires whether a visa is needed for any of the countries that are to be visited according to the selected programme, and the Traveller is also obliged to obtain on his/her own a visa for the country in question. Pustolovni Centar d.o.o. shall not be held responsible for the decisions made by custom authorities, police authorities or any other state authority banning the Traveller from entering a certain country.

 

8. TRAVELLER’S DUTIES

The traveller is personally obliged to make sure that his/hers documents and property comply with conditions set forth by border, custom, health and other regulations of his/her own country as well as the country of destination, and to abide by catering establishment’s and/or hotel’s House Rules, as well as to co-operate in good will with trip organiser’s representative and service providers.

Should the Traveller fail to respect these duties, the Traveller shall be held responsible for the damage made, and Pustolovni Centar d.o.o. shall not be held responsible for the damage made. In any such case the damage amount shall be reimbursed directly by the Traveller to the owner of the venue in question (hotel, suit etc.), at the reception desk.

Also, due to specific qualities of adventure travel the clients shall have certain obligations towards the trip organiser, but also towards other travellers. Every traveller shall be obliged to make detailed inquires about the travel he/she would like to pay for, and should choose a travel (with suggestions made by Pustolovni Centar d.o.o.) that shall suit the Traveller’s interests and physical and health abilities.

 

9. LIABILITY INSURANCE

According to the Tourism Services Act, Pustolovni Centar d.o.o. shall have a signed agreement with the insurer against liability for damage caused to the Traveller by failing to meet, partially failing to meet or meeting in a neglected manner obligations relating to the package tour.

 

10. INSURANCE

For tours and package tours organised by the Agency, Pustolovni Centar d.o.o. is insured with the EUROHERC OSIGURANJE – insurance company.

 

11. COMPLAINTS AND ARBITRATION

If the programme services are incomplete or executed below standard and in low quality, the Traveller shall have the right to demand proportional compensation by doing the following:

- Claim, on the spot, inappropriate service rendering to the Organiser’s representative. The Traveller is obliged to co-operate in good will in order for the causes of the complaint to be eliminated;

- No later than eight days upon the return from the trip the Traveller is obliged to submit a written complaint sent via email, and addressed to the place of package tour purchase respectively, and submit a written confirmation made by our representative as well as possible bills for additional expenses; after the expiry of the eight days upon return deadline, your complaints shall not be taken into consideration

- The Organiser is obliged to hand in a written Decision regarding your complaint within 8 days upon the receipt of the complaint in question

-  Before the Organiser hands in the Decision, the Traveller shall waive any mediation offered by any other person or court, and shall relinquish the right to make information public and available to press, online community, etc;

The Traveller is entitled to compensation in the amount of real value of services that have not been provided, whereas the highest indemnity per complaint may amount to the amount of the package tour price. The Buyer shall waive the right to ideal compensation. All and any possible disputes shall be settled at a Zagreb based court.
